ANJANA MISHRA ORAL ORDER 18-04-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Mirganj P.S. Case No. 77 of 2015 registered for the offence punishable under Section 272 of the Indian Penal Code and Section 47(a) of the Excise Act.
Learned counsel for the petitioner submits that admittedly, there has been no recovery from the conscious possession of the petitioner and it is his first offence. The petitioner has no criminal antecedent.
Considering the aforementioned facts and circumstances, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of
Patna High Court Cr.Misc. No.3934 of 2016 (2) dt.18-04-2016 2/2 receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Sessions Judge, I-cum-Additional Chief Judicial Magistrate, Purnea in connection with Mirganj P.S. Case No. 77 of 2015, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
