====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 31-07-2026 Heard Mr. Akash Anand, learned counsel appearing on behalf of the petitioner and Mrs. Nirmala Kumari, learned APP for the State.
2. The petitioner seeks pre-arrest bail in connection with Tikapatti P.S. Case No. 27 of 2026, registered for the offence punishable under Sections 126(2), 352/351(2) and 3(5) of the BNS and Section 8 of the POCSO Act.
3. As per the allegation made in the FIR, the petitioner had allegedly tried to outrage the modesty of the minor daughter of the informant.
4. Learned counsel appearing on behalf of the petitioner submitted that the parties have entered into compromise and a joint compromise petition has been filed
Patna High Court CR. MISC. No.36180 of 2026(3) dt.31-07-2026 2/2 before the learned Additional Sessions Judge-VIIth-cum-Special Judge, POCSO Act, Purnea. Learned counsel further submitted that petitioner and informant are close rleative. Victim is own sister of brother-in-law of the petitioner, who is aged about 21 years and has just emerged as an adult.
5. After some arguments, learned counsel appearing on behalf of the petitioner seeks to withdraw the present bail application with a liberty to the petitioner to surrender before the learned District Court and seek regular bail.
6. In view of the aforesaid submission made on behalf of the petitioner, the petitioner, if so advised, may surrender before the learned District Court and seek regular bail. In that case, the learned District Court may consider the bail application of the petitioner same day and pass a reasoned order in accordance with law.
7. Accordingly, the present bail application stands disposed of.
