The petitioner seeks bail in a case registered under Section 394 of the Indian Penal Code.

Allegation is that three unknown persons surrounded the informant and assaulted him with knife and snatched a bag containing Rs.59,945/- and a mobile of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.01.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.l.I.R. His name has come on confessional statement of co-accused. The petitioner has not been put on

Patna High Court CR. MISC. No.38939 of 2019(2) dt.28-06-2019 2/2 T.I.P. Recovery of Rs.11,000/- is claimed by the petitioner. The case is triable by the Magistrate. Co-accused has been granted bail vide Cr.Misc.No.26592 of 2019.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 14th, Chapra, Saran in connection with Garkha P.S. case No,.149 of 2018.
