Petitioner is apprehending his arrest in connection with Chanpatiya (Sirisiya O.P.) P.S.Case No.468 of 2017 dated 28.12.2017, registered for offences punishable under Sections 414, 272, 273 of the Indian Penal Code and Section 30/30(A) of the Bihar Prohibition and Excise Act.

Prosecution story is that the police intercepted one motorcycle, one person was arrested and one person succeeded in fleeing away. 08 ltrs. of liquor has been recovered from the motorcycle. Arrested accused person disclosed the name of the person who succeeded in fleeing away. Submission of the learned counsel for the petitioner is that there is no recovery from the possession of the petitioner

Patna High Court CR. MISC. No.34889 of 2019(3) dt.21-08-2019 2/2 and the motorcycle does not belong to the petitioner as well as he has no criminal antecedent.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bettiah, West Champaran in connection with Chanpatiya (Sirisiya O.P.) P.S.Case No.468 of 2017, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
