2. Petitioner apprehends arrest in case registered for the offences punishable under Sections 175, 409 of the Indian Penal Code.

3. It is alleged that despite direction of District Programme Officer, Education Department, Bhagalpur, petitioner did not submit merit list and other certificates to the District Education Officer for verification and enquiry.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He further submits that it was the previous Panchayat Secretary who did not obey the order, whereas, petitioner joined as Panchayat Secretary later on. Moreover, F.I.R. has been lodged after inordinate delay of two months which itself raises

5. However, learned A.P.P. for the State vehemently opposed the bail application and submitted that pursuant to order of Hon'ble High Court passed in CWJC No. 15459 of 2014, a direction was given by District Programme Officer, Education Department, Bhagalpur, to submit the employee merit list of teachers training, folder of certificate for verification but petitioner ignored and failed to provide the same. Petitioner has got two criminal antecedents of similar nature.

6. Considering the nature of accusation and criminal antecedent of similar nature, prayer for anticipatory bail of the petitioner is refused.
