2. The petitioner seeks bail in connection with Banka P.S. Case No. 559 of 2023 registered for the offences under Sections 147, 149, 341, 504, 420, 467, 468, 471 and 341 of the Indian Penal Code.

3. The petitioner is named in the F.I.R. and is in custody since 04.03.2025.

4. The allegation against the petitioner is to cheat informant in connection with sale of piece of a land by creating forged documents along with other co-accused persons.

5. Learned counsel appearing on behalf of the petitioner submitted that petitioner is not beneficiary of the sale proceeds and he is only identifier of executor of the sale deed during its registration. It is submitted that with this limited allegation petitioner is in custody since seven months. It is pointed out that

Patna High Court CR. MISC. No.40235 of 2025(4) dt.17-10-2025 2/2 dispute between the parties appears civil in nature, where present criminal implication is completely unwarranted. While concluding the argument it is submitted that, petitioner is a man of clean antecedent and moreover, investigation of this case has already completed, and as such, there is no chance of tampering with the evidence.

6. Learned APP appearing on behalf of the State, opposes the prayer for bail.

In view of aforesaid factual submission and by taking note of fact as prima-facie allegation against petitioner is only to identify the signature of the executor of the sale deed, coupled with the fact as petitioner remains in custody since 04.03.2025, accordingly above named petitioner, is directed to be released on bail in connection with Banka P.S. Case No. 559 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka/concerned court, subject to the conditions as mentioned under Section 480(3) of the B.N.S.S.
