An Advocate practicing in the Buxar Court has filed the present application with respect to Buxar P.S. Case No.329 of 2015 for the offence under Section 387, 506, 120(B) of the Indian Penal Code.

A letter was served to the Registrar of Civil Court, Buxar in the name of Soni Devi wife of Kamlesh daughter of Vijay Lal, resident of Sohnipatti, Buxar demanding an extortion money of Rs.10 lacs. When police has started investigation, it transpired that the said letter had been written by the petitioner as he carries a litigation with Soni Devi and on that account, he has committed such mischief. Looking to the facts and circumstances of the case, petitioner namely Saurav Kumar Srivastava is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar in connection with Buxar(T) P.S. Case No.329 of 2015 subject to the conditions that: (i) one of the bailors will be mother of the petitioner, (ii) if the petitioner will remain absent on two consecutive dates, the court below will cancel the bail of the petitioner, and (iii) if the petitioner repeats same mischief in future in any form against Soni Devi or any other person that will also be a ground for the cancellation of the bail of the petitioner.
