2. The petitioner has preferred this application for grant of regular bail in connection with Dariyapur P.S. Case No. 74 of 2025 registered for the offences punishable under Sections 80, 238, 61(2) and 3(5) of the BNS.
3. As per the prosecution story, the informant has alleged that on 10.02.2025 at around 10:30 AM, he received information regarding the death of his sister. Upon visiting her matrimonial home to verify the information, he found the house in complete disarray, with scattered household items and no one was present at the premises. Upon inquiry from the neighbours, he was informed that approximately at 11:00 AM,
Patna High Court CR. MISC. No.35587 of 2025(3) dt.10-09-2025 2/3 the deceased's father-in-law, along with others, had wrapped the body in a blanket and took it elsewhere on a motorcycle. It is further alleged that since the marriage, the deceased had been subjected to continuous demands for dowry and was mentally and physically harassed by her in-laws.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case due to the ulterior motives of the informant. The allegations levelled against the petitioner are false, fabricated, and devoid of any merit. It is further submitted that the accusations regarding demand of dowry are general, omnibus in nature, and lack specific details. The petitioner, who is the mother-in-law of the deceased, had been residing separately from the deceased and her husband, both in terms of household (mess) and business, since the time of their marriage. The petitioner is a woman of clean antecedents and is languishing in custody since 11.03.2025.
5. Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.
