The petitioner is in custody since 23.12.2022 in connection with Lakhisarai (Kabaiya) P.S. Case No. 1023/2022 registered for the offence punishable under Sections 414/34 of the Indian Penal Code.

As per the prosecution case, petitioner is an accused of motorcycle theft which has been recovered from the house of the petitioner.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case due to dirty village politics. He further submits that the stolen motorcycle has been recovered from the house in which many family members are living together.

No.37958 of 2023(2) dt.21-07-2023 2/2 Considering the facts and circumstances of the case and also the fact that the petitioner has criminal antecedent of similar nature, this Court is not inclined to grant him the privilege of bail.
