The petitioner is seeking bail in connection with Sonbarsa P.S. Case No.6 of 2015 for the offence under Sections 341, 323, 504, 498A of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.

In the present application, allegation has been made that the petitioner has entered into marriage according to the muslim rites with Sabila Khatoon @ Tetri, but the marriage could not sail smoothly which led to filing of this case. Allegation has been made that the petitioner has not been keeping her in proper manner rather torturing. On 27.09.2014, he tried to kill her but somehow she escaped.

Patna High Court Cr.Misc. No.51181 of 2015 (2) dt.10-11-2015 The counsel for the petitioner submits that petitioner is ready to pay Rs.1,500 per month and the counsel for the informant in view of the assurance of the payment of aforesaid amount, is not resisting for granting of bail.

Looking to the facts and circumstances of the case, petitioner namely Md. Imteyaz Ahamad is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sonbarsa P.S. Case No.6 of 2015 with the direction that petitioner must pay Rs.1,500 by 7th day of each calendar month. In failure to make payment, the grant of bail will be cancelled. The informant is directed to supply the Bank account so that the petitioner would credit the aforesaid amount in her account.
