The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 142, 143, 149, 147, 148, 323, 325, 307, 353, 333, 435 and 427 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner, who has clean antecedent, is innocent and has not committed any offence. In fact, the co-accused having more or less similar allegation has already been granted the anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No. 35784 of 2019 on 10.06.2019 and the case of this petitioner stands on similar footing. Hence, the petitioner may be granted the

Patna High Court CR. MISC. No.35330 of 2019(3) dt.07-08-2019 2/2 privilege of anticipatory bail.

Considering the facts of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Rosera, DistrictSamastipur, in connection with Hathauri (Shivajeenagar OP) P.S. Case No. 16 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court blow shall be at liberty to cancel the bail bond of the petitioner.
