2. The petitioners apprehend their arrest in connection with Chandramandi P.S. Case No. 218 of 2024 dated 12.11.2024 registered under Sections 126(2), 115(2), 109(2), 117(2), 118(2), 351(2), 352 3(5) of the BNSS, 2023

As per the First Information Report on 12.11.2024, cousin brothers of the informant including the present petitioners along with other co-accused persons seven in numbers arrived and started abusing the informant and others for vacating the old house. The accused persons also started assaulting them due to which, the elder son of the informant
Patna High Court CR. MISC. No.37075 of 2025(2) dt.25-06-2025 2/3 sustained head injury. The third son of the informant was bitten by teeth and was also assaulted on his head by means of spade by Basuki Pandit, petitioner no.2.

Learned counsel for the petitioners submits that both the parties are co-sharers/cousins and there is dispute regarding old house between them, a counter case has also been lodged by the side of the petitioners against the informant and others. Side of the petitioners have also sustained injuries which has been annexed as Annexure-P/3. Some of the co-accused persons from the side of the informant have also been granted anticipatory bail by a Co-ordinate Bench of this Court vide Cr. Misc. No. 20416 of 2025 (Annexure-4). It is next submitted that the allegation against the petitioners is general and omnibus in nature.

On the other hand, the learned State counsel opposes the prayer and submits that the petitioners and others arrived at the old house of the informant, pressurized them to vacate the same and upon protest, they assaulted the informant's sons due to which the elder son of the informant sustained grievous injury on his head, which would be evident from the impugned order itself.
6. Regard being had to the submissions made by the

No.37075 of 2025(2) dt.25-06-2025 3/3 parties, taking into consideration the fact that both the parties are co-sharers/cousins, case and counter case is there, both sides have sustained injuries, some of the accused persons from the informants' side, in connection with the same incident, have been granted anticipatory bail by a Bench of this Court, I am inclined to grant anticipatory bail to the petitioners.
7. Let the petitioners, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Chandramandi P.S. Case No. 218 of 2024 subject to the condition as laid down under Section 482 (2) of the B.N.S.S., 2023.
