The petitioner being the neighbour of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 504 of the Indian Penal Code and 3(1) (x) of the S.C./S.T.(Prevention of Atrocities) Act.

The prosecution case is that the in the background of fight between the sons of the petitioner and informant, the petitioner made assault to the informant and abused by calling caste name.

It is submitted by the learned counsel for the petitioner that for the occurrence of 31.08.2015 the First Information Report was registered on 05.09.2015. The

Patna High Court Cr.Misc. No.4771 of 2016 (2) dt.04-02-2016 petitioner is neighbour of the informant. The informant has retracted from the initial version and filed a petition to that effect before learned court below. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Considering the genesis of the occurrence and the retracted version of the informant, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sri Uma Shankar, J.M., Sikrahana at Dhaka, East Champaran in connection with Chiraiya P.S. Case No. 189 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
