1. Heard learned counsel for the parties.

2. The petitioner has renewed his prayer for grant of regular bail in connection with Sessions Trial no.387 of 2024, arising out of Phenhara P.S Case no. 160 of 2023 registered under sections 307, 341, 323, 325, 504, 506 and 34 of the Indian Penal Code.

3. As per the prosecution case, the informant states that the petitioner who happens to be one of his sons along with his wife came to him, abused and assaulted him, thus seriously injuring him.

4. It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 21.3.2024 (Annexure-1) passed in Cr. Misc. no. 1325 of 2024 giving liberty to the petitioner to renew his prayer

Patna High Court CR. MISC. No.41589 of 2024(2) dt.16-07-2024 2/2 for bail on completing one year in custody or after framing of charge, whichever is earlier. Referring to the order dated 26.4.2024 contained in Annexure-3, it is submitted that charge has been framed against the petitioner. The petitioner is in custody since 4.11.2023 and undertakes to cooperate in the trial.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, liberty granted to the petitioner by the aforesaid order of rejection dated 21.3.2024, charge having been framed in the case together with the petitioner having remained in custody since 4.11.2023, the petitioner is directed to be enlarged on bail in connection with Sessions Trial no.387 of 2024 (arising out of Phenhara P.S Case no. 160 of 2023) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-XIII, East Champaran at Motihari.
