JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-11-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 448, 427, 504 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act.
It is alleged that accused persons assaulted the informant and his cousin brother Guddu Chaudhary @ Pramod Chaudhary. The accused persons also damaged the roof of the house and door of the informant.
It is submitted by learned counsel for the petitioners that accusation is omnibus and general. The petitioners' side lodged the case at earlier point of time and the injury has been found to simple in nature.
The aforesaid facts constitute ground for
Patna High Court Cr.Misc. No.50976 of 2015 (2) dt.06-11-2015 2/2 consideration of prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with Akbarpur P.S. Case No. 52 of 2015, pending in the Court of learned Chief Judicial Magistrate, Nawada.
With the observations above, the application stands disposed off.
