Mr. Ashok Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 20-06-2025 Heard Mr. Shivendra Kumar Sinha, learned counsel for the petitioners and Mr. Ashok Kumar Singh, learned APP for the State.
2. The petitioners apprehend their arrest in connection with Tetiabambar P.S. Case No. 06 of 2025 dated 08.01.2025 registered for the offences punishable under sections 191(2), 191(3), 115(2), 109, 117(4) and 351(2) of the Bharatiya Nyaya Sanhita.
3. The main submissions advanced by petitioners' counsel are that the instant matter relates to free fight in which

No.36273 of 2025(2) dt.20-06-2025 2/3 persons from both the sides sustained injuries and the genesis of the occurrence was an issue of demarcation in respect of drainage, which resulted in free fight in between them and now both the sides have compromised and in this regard, a specific statement has been made in the para '7' of this petition. It is further submitted that in the instant matter three persons, namely, Manoj Kumar Yadav, Sanjeet Kumar and Sajan Kumar are said to have been assaulted by the petitioners, out of these said injured persons, the injury report of two injured persons has been filed with the petition as Annexure- 2 series, which shows that they sustained simple injuries and the injury report in respect of third injured person was not issued and the same is not available and from the petitioners' side, one namely Ashok Yadav, father of the petitioners, sustained injury in the alleged occurrence of free fight, whose injury report's copy has been filed as Annexure- '3'.
4. Learned APP appearing for the State has opposed the bail prayer of the petitioners.
5. In the facts and circumstances of this case as well as considering the aforesaid submissions and mainly the petitioners' plea as to free fight having taken place in between both the parties resulting in injuries to both the sides as stated

No.36273 of 2025(2) dt.20-06-2025 3/3 above and also the good relation having been restored in between them as per the statement made in para '7' of the petition, in my opinion, it is a fit case to the grant of relief of anticipatory bail to the petitioners. Accordingly, let the petitioners named-above, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Tetiabambar P.S. Case No. 06 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
