The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 467, 468, 471, 420, 120B of the Indian Penal Code. The prosecution case is that the petitioner and one Vijay Prasad persuaded the informant to deposit a sum of Rs. 90,000/- in Om Jyoti Marketing Private Limited, Head Office, Gaya with an assurance that informant would be getting a sum of Rs.5,00/- per month till the repayment of the entire invested amount. It is alleged that the accused persons neither repaid the total invested amount nor the total agreed monthly amount. It is submitted by the learned counsel for the petitioner that initially the complaint was filed which came to be registered as police case on 11.06.2013. Paragraph-8 of the

Patna High Court Cr.Misc. No.3927 of 2016 (2) dt.27-01-2016 complaint petition suggests that for the investment made in 2005 the complaint has been made in 2013. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. Similarly situated co-accused Vijay Prasad has been granted bail by a Coordinate Bench of this Court vide Cr. Misc. No. 44972 of 2015.

Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Aurangabad in connection with Daudnagar P.S. Case No. 189 of 2013, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Dinesh Kumar Singh, J) P.K./- U T
