JUSTICE SUDHIR SINGH ORAL ORDER 18-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 147, 148, 149 and other allied Sections of the Indian Penal Code and Section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Allegation against the petitioners is that they assaulted informant and his family members. They also damaged the articles kept in the house.
It is submitted on behalf of the petitioners that they have falsely been implicated in the present case. From perusal of the injury report it appears that nature of injury is simple. There is admitted enmity between the parties.
On behalf of the State, it is submitted that petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on
Patna High Court Cr.Misc. No.5469 of 2016 (2) dt.18-03-2016 2/2 furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran, in connection with Adapur (Harpur) P.S.
