JUSTICE SANDEEP KUMAR ORAL ORDER 15-09-2025 Heard the learned counsel for the petitioner, learned APP for the State and the learned counsel for the informant.

2. The petitioner seeks regular bail in connection with Beur P.S. Case No. 128 of 2025 registered for the offence under Sections 103(1), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner is said to have killed the deceased.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 09.03.2025.

5. Learned A.P.P. for the State as well as the learned

Patna High Court CR. MISC. No.38679 of 2025(4) dt.15-09-2025 2/2 counsel for the informant have vehemently opposed the prayer for bail.

6. Though the petitioner is said to have participated in the killing of the deceased but one Saurav Kumar, an injured witness has said that one Rahul Kumar was trying to test his firing skills and in that, due to accident, the deceased was shot and killed.

7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, Patna /concerned Court below in connection with Beur P.S.
