The petitioner seeks bail in connection with Sessions Trial No.281 of 2015, arising out of Pusa P.S. Case No.72 of 2014 (G.R. No.1477 of 2014), registered under Sections 395 and 397 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, the petitioner was apprehended by the police showing the recovery of firearms regarding which Samastipur (Mufassil) P.S. Case No.242 of 2014 was instituted and, thereafter, the police also got recorded the confessional statement

Patna High Court Cr.Misc. No.50451 of 2015 (3) dt.04-02-2016 2/2 of the petitioner showing his involvement in the present case. Except that, there is nothing to connection the petitioner in the commission of the alleged offence. The petitioner is in custody since 05.09.2014. Further submission is that as the petitioner is accused in several cases, as detailed in paragraph-3 of this application, that is the reason the petitioner has falsely been implicated in this case by the police.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-V, Samastipur, in connection with Sessions Trial No.281 of 2015, arising out of Pusa P.S. Case No.72 of 2014 (G.R. No.1477 of 2014). Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner. (Rajendra Kumar Mishra, J) P.S./- U T
