====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 13-09-2024 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks regular bail in connection with Raghopur P.S. Case No.304 of 2022, registered for the offences punishable under Sections 379, 356/34 of the Indian Penal Code.

3. As per the prosecution case, when the informant was returning on his motorcycle, three miscreants came and snatched the key of the motorcycle and bag of the informant containing mobile phone and other articles.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that petitioner is not named in the F.I.R., however, his name has been transpired in this case on the

Patna High Court CR. MISC. No.41117 of 2024(3) dt.13-09-2024 2/2 basis of confessional statement of co-accused. Learned counsel submits that nothing incriminating article has been recovered from the conscious possession of the petitioner. He further submits that similarly situated co-accused has already been granted bail by this Court vide order dated 21.08.2024 passed in Cr. Misc. No.52157 of 2024. Learned counsel submits that petitioner has two criminal antecedents, he is in custody since 20.01.2024 and the charge sheet has already been submitted in this case.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Raghopur P.S. Case No.304 of 2022.
