====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 20-09-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are seeking anticipatory bail in connection with Sabour P.S. Case No. 328/2018 registered under Sections 341, 307, 504, 506, 120(B) of the Indian Penal Code.

Learned counsel for the petitioners submits that the allegation of repeated blow on the head of the informant is against one Sitaram Mandal and there is no allegation of firing against these petitioners, however petitioners have no criminal antecedent.

Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.

No.38805 of 2019(3) dt.20-09-2019 2/2 In given facts and circumstances of the case, wherein the specific allegation of giving repeated blow on the head of the informant has been mad against one Sitaram Mandal and there is no allegation of firing against these petitioners as also that these petitioners have no criminal antecedent, in the event of their arrest/surrender before the court below within a period of four weeks, let the above-named petitioners be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Sabour P.S. Case No. 328/2018, subject to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
