JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 06-10-2021 The appellant has put to challenge an order dated 09.06.2020 passed by learned Special Judge SC/ST Act, Gaya in SC/ST Case No. 116 of 2020 arising out of Imamganj P.S. Case No. 24 of 2016 disclosing commission of offence punishable under Section 302 read with Section 34 of the Indian Penal Code, Section 27 of the Arms Act and Section (2) (V) of the SC/ST Act whereby his prayer for regular bail has been rejected. This is appellant's second attempt before this Court for his release on regular bail.

In compliance of this Court's order dated 08.09.2021, a report has been submitted by the Court below regarding present stage of the trial from which it appears that prosecution's witnesses have been summoned and at least one

The appellant's prayer for grant of regular bail was earlier rejected by this Court after examining the merits of the case. In the facts and circumstances of the case, it is considered appropriate to dispose of this appeal with an observation that let the conclusion of the trial be expedited before the Court below.

If the trial is not concluded within six months from today, the appellant shall be at liberty to renew his prayer for regular bail before the Court below.

This appeal stands disposed of accordingly.
