The petitioners are apprehending their arrest in connection with Saharsa P.S. Case No. 786 of 2015 registered under sections 302, 120(B)/34, 364 of the Indian Penal Code. It is submitted on behalf of the petitioners that the husband of petitioner no. 2 died very recently and Awadhesh Sharma against whom there is main allegation is already in custody. So far as petitioner no. 1 Rani Devi is concerned, she is daughter-in-law of the family and wife of the main accused Awadhesh Sharma.
Considering the nature of allegation made and
Patna High Court Cr.Misc. No.4965 of 2016 (2) dt.18-02-2016 that now, as stated by Sri Pramod Kumar Mishra, learned counsel for the petitioners, Awadhesh Sharma, husband of petitioner no. 1 has already surrendered pursuant to the direction made by a Bench of this Court in the interim order dated 02.02.2016 in Criminal Misc. No. 3175 of 2016, the petitioners above named, in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Saharsa P.S. Case No. 786 of 2015 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure, 1973.
