The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 275, 276 of the Indian Penal Code, Section 30(a) of the Bihar Prohibition & Excise Act and Section 21(b)(c) of the N.D.P.S. Act.
The prosecution case as per F.I.R is that 290 bottles of WISCOF Syrup each containing 100 ML were recovered from a rented room of a lodge. The petitioner is owner of the said lodge.
It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this
Patna High Court CR. MISC. No.46269 of 2021(3) dt.21-03-2022 2/2 case. The said room has been taken on rent by one Md. Mukhtar and Md. Shadique Anwar. The petitioner is an old person and he had absolutely no knowledge about the activities of the renters. Nothing has been recovered from the conscious possession of the petitioner. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
Considering the aforestated facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Special Judge, NDPS Act, Purnea in connection with K. Hat (Sahayak) P.S. Case No. 175 of 2021, corresponding to Special Case No. 12 of 2021, arising out of CIS No. 256 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
