The petitioner seeks bail in connection with Pirbahore P.S. Case No. 303 of 2020, registered under Section 420 of the Indian Penal Code.

The accusation is that complainant Kapildeo Mahto went at PMCH in surgery department, on suffering from cough & cold, and desired for corona test. In the meantime, one other patient present there gave him mobile number of Md. Yusuf Ansari (Petitioner) for corona test. Thereafter, informant talked to petitioner, who replied that there is long queue for Corona test and for which he is

Patna High Court CR. MISC. No.33888 of 2020(2) dt.08-01-2021 2/2 charging Rs. 3500/-. The petitioner assured that since complainant is student, he would charge Rs.1000/- for him. Thereafter, petitioner called complainant Kapildeo Mahto at main gate of nursing hostel and took Rs. 1000/-. Learned counsel appearing for the petitioner submits that petitioner is registered Pharmacist and he used to do job in Amrit Pharma, Patna. He further submits that, in fact, the complainant had come at his medical shop and purchased some medicine worth of Rs. 880/- and he handed over a currency note of Rs. 2000/- and after deducting the charge of purchased medicine, remaining amount was returned to the complainant, but after some interval, he again came at the shop and stated that he has been provided less money. The petitioner has no criminal antecedent and he is in custody since 13.08.2020.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in connection with Pirbahore P.S.
