JUSTICE SUDHIR SINGH ORAL ORDER 18-12-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 498-A, 323 and 504/34 of the Indian Penal Code. Allegation against the petitioner is to have tortured and ousted the complainant from matrimonial house for nonfulfillment of demand of dowry. It has been submitted on behalf of the petitioner that he is in custody since 22.6.2015. He has got no criminal antecedent. There is no allegation of tampering of evidence against the petitioner. Petitioner has falsely been implicated in the present case. It is further submitted that petitioner is ready to pay an amount of Rs. 2,000/- per month to the complainant in pursuance of the order passed by the Principal Judge, Family Court, Madhubani, in M.R. no. 69 of 2013 dated 2.4.2015. On behalf of the State and the informant, it is submitted

Considering the aforesaid facts and circumstances, it is directed that petitioner shall deposit an amount of Rs. 2,000/- per month in the court below which shall be released in favour of the complainant.
Let petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Ravi Shankar, Judicial Magistrate, Ist Class, Madhubani, in connection with Complaint Case no. 344 of 2013 ( Trial no. 4235 of 2014). If the petitioner fails to comply with the order dated 2.4.2013 passed in M.R. no. 69 of 2013, the court below will be at liberty to cancel the bail granted to the petitioner.
