JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 30-01-2016 Heard learned counsel for the petitioner as well as learned APP for the State.

It has been alleged at the end of informant Munna Yadav on 07.08.2015 at about 9:00 A.M., that his co-villagers Deepak Kumar, Pappu Chaudhary, Raju Chaudhary, Manoj Chaudhary, Raj Kishore Chaudhary and Jageshwar Chaudhary forming an unlawful assembly came and began to abuse. On protest, they began to fire indiscriminately and during course thereof, Deepak Kumar and Manoj Chaudhary fired at Aman Kumar while Manoj Chaudhary shot at Manoj Kumar, son of informant. Then thereafter, they all assaulted his family members with Fasuli, a sharp cutting weapon, Garasa and Lathi. From perusal of the case diary, it is evident that injury report of only two persons, i.e. Aman Kumar and Munna Yadav is

There happens to be no specific allegation against the petitioner who is under custody since 08.08.2015. Accordingly, petitioner Jageshwar Chaudhary @ Jugeshwar Chaudhary is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri R.K. Pandey, Judicial Magistrate, 1st Class- Gaya in connection with Buniyadganj PS Case No. 144/2015.
