Petitioner apprehends his arrest in Arwal P.S. Case No.29 of 2019, registered under Sections 384, 385, 354, 355, 504, 506 and 34 of the Indian Penal Code.

The informant in sum and substance made allegation that the petitioner being a journalist demanded extortion for publishing a fake news in newspaper to tarnish the image of the informant who is the District President of Janta Dal (U). The petitioner got Rs.10,000/- but later on, on 03.01.2019 gave false information against the informant about running a flesh trade in the house of his relative. The police apprehended the informant but later on after enquiry the police found the allegation false. It is

Patna High Court CR. MISC. No.33967 of 2019(2) dt.23-05-2019 2/2 further alleged that the petitioner again got a news published in the newspaper with an object to ruin the character and future of the informant.

Learned counsel for the petitioner submits that the occurrence is dated 04.12.2018 but the FIR was lodged on 29.01.2019. The petitioner is a journalist and he reported some misdeeds of the informant and that news was published in the newspaper that is why the petitioner has filed this case making false and concocted story of demand of extortion. Having considered the submissions and the facts that the petitioner is a journalist and he admitted that he got some news published with regard to the misdeeds of the informant, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Arwal in connection with Arwal P.S. Case No.29 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
