JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 14-12-2023 Pursuant to the last order passed by this Court, the joint supervision was conducted by the Deputy Superintendent of Police (Headquarter), Vaishali and the Sub-Divisional Police Officer, Mahua.

2. In paragraph '7' of the counter affidavit filed on behalf of the respondent no.2 it is stated that one of the accused, namely, Digvijay Singh has surrendered on 03.11.2023 in court

Patna High Court CR. WJC No.1037 of 2023(3) dt.14-12-2023 2/2 and he is on bail and rest all the accused persons are absconding and against them the Investigating Officer has executed the processes under Sections 82 and 83 Cr.P.C. on 26.11.2023.

3. The joint report of supervision has been brought on record as Annexure 'A' to the counter affidavit. It is stated on behalf of the State that from the joint supervision note itself it would appear that the investigation of the case is being properly done, hence no interference at this stage is required.

4. Having regard to the statements made in the counter affidavit, this Court is of the considered opinion that this writ application be disposed of with a direction to the supervision authorities to ensure proper and fair investigation of the case and submission of a police report in the court of learned jurisdictional Magistrate within a reasonable time, preferably within a period of four months from the date of communication of this order.
