Mr.Akbar Ali ====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 16-06-2025 Heard learned counsel for the petitioner and learned A.P.P for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Silao P.S. Case No. 192 of 2023 dated 12.07.2023 registered for the offences punishable u/s 302 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is alleged to have assaulted the informant's son with knife due to that he died during the course of the treatment.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that the petitioner is suffering

Patna High Court CR. MISC. No.35535 of 2025(2) dt.16-06-2025 2/2 from mental disease since long time. The petitioner is a government teacher in Urdu primary school MS Body Katarisarai, Nalanda. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 13.07.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that there is specific allegation against the petitioner of stabbing the informant's son due to that he died. It is further stated that as per the postmortem report, mentioned in the impugned order, the cause of death is stabbing wound by sharp edged weapon.

6. Considering the aforesaid facts and circumstances of the case as well as the specific and heinous nature of allegation against the petitioner , I am not inclined to enlarge the petitioner on bail.

7. The application stands rejected.
