The petitioner has renewed his prayer for grant of regular bail in a case registered under sections 307, 452, 504, 506 and 34 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, Dhanji Yadav is said to have fired hitting the informant in his chest while Dharmendra Yadav fired hitting the informant.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 7.2.2022 (Annexure-1) passed in Cr. Misc. No. 35983 of 2021. It is submitted that the specific allegations as per the FIR are against Dhanji Yadav and Dharmednra Yadav while

The case of the petitioner stands on a similar footing to that of co-accused Kundan Yadav who has been enlarged on bail vide order dated 8.6.2022 passed in Cr. Misc. no. 718 of 2022. The petitioner is in custody since 27.2.2021 and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the nature of allegation in the FIR, grant of bail to co-accused Kundan Yadav together with the petitioner having remained in custody since 27.2.2021, the petitioner is directed to be enlarged on bail in connection with Ara Town P.S. Case no. 444 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara.
