JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 28-04-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard the learned counsel for the petitioner as well as the learned counsel for the informant. The petitioner apprehends his arrest for the offences alleged under Sections 341, 323, 307, 379, 504 and 34 of the Indian Penal Code, registered in connection with Buxar (M) P.S.Case No. 139 of 2021.

As per allegation, when the informant went to his field to harvest the crops, the accused persons came there. The allegation against the petitioner is that on exhortation of coaccused Ramjee Singh, he inflicted farsa blow on the head of the informant. Co-accused Sunil Singh and Ramjee Singh assaulted the informant near his left eye, mouth and legs etc. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.46103 of 2021(2) dt.28-04-2022 2/2 that there is land dispute between both the parties. The mother of the petitioner has also lodged FIR against the informant's side. She has submitted further that two injuries were found on the person of the injured. Injury no.1, which is attributed against the petitioner is simple in nature. Injury no.2, although grievous in nature, but it is attributed against co-accused persons. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Buxar in connection with Buxar (M) P.S.Case No 139 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
