JUSTICE SUDHIR SINGH ORAL ORDER 16-12-2015 The bail application of the petitioner was earlier rejected vide order dated 11.6.2015 in Cr. Misc. no. 17576 of 2015. The trial court was directed to take all necessary steps to expedite the trial and liberty was given to the petitioner to renew his prayer after completion of nine months in custody.

A report was called for from the trial court vide order dated 4.11.2015 and the same is kept at flag 'A'. From perusal of the said report submitted by the trial court it appears that out of six witnesses, three prosecution witnesses have already been examined.

Learned counsel for the informant submits that during the pendency of this application the informant has also been examined. Only investigating officer is to be examined in the present case.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner, same is rejected. Any how, the trial court is directed to take all necessary

Patna High Court Cr.Misc. No.49028 of 2015 (3) dt.16-12-2015 2 / 2 steps to conclude the trial in connection with S.T. no. 156/2015/S.T. no. 157 of 2015 arising out of Masahi P. S. case no. 110 of 2014 within a period of three months from the date of receipt/production of a copy of this order.

The District Magistrate, Katihar, is also directed to take all necessary steps to ensure that the investigating officer is present on the date fixed by the trial court so that the trial could be concluded within the stipulated period.

Let a copy of this order be communicated to the District Magistrate, Katihar.
