The petitioner seeking compassionate appointment does not dispute that his mother is working as Anganwari Sevika and never exercised option for compassionate appointment. The petitioner has no locus to maintain the writ petition under the guidelines in force in the circumstances where the widow never claimed compassionate appointment nor while waiving her claim had suggested for the petitioner rather continues to work as an Anganwari Sevika.

Patna High Court CWJC No.20380 of 2016 dt.14-11-2017 The writ petition is misconceived in the circumstances discussed and is dismissed accordingly.
