Through this writ application, the petitioner seeks direction to the District Magistrate, Bhojpur, Ara to enter the details of his arms licence in the Arms Register of the district of Bhojpur for its future renewal.
It is contended that the petitioner was granted arms licence for DBBL gun by the competent authority in the State of Jammu & Kashmir while he was in service of the Indian Army. The petitioner purchased a DBBL Gun on the aforesaid licence which was valid throughout the territory of India. After his retirement in the year 2011, he claims to have become permanent resident of his native village Barauli, P.S. Ara Muffasil, DistrictBhojpur. Since the petitioner was facing problem in renewal of arms licence as it was renewed time to time on earlier occasions
Patna High Court CWJC No.2541 of 2016 (2) dt.29-02-2016 2/2 whenever required and wherever the petitioner was posted, he made a request on 9.10.2014 to the District Magistrate for entering the arms licence in the Arms Register in the district of Bhojpur and, thereafter, for its renewal vide Annexure-2 and 3. It is submitted that despite arms licence of the petitioner was renewed lastly by the District Magistrate, Kathua on 28.12.2014 till 31.12.2017 and no objection certificate has also given by the Additional District Magistrate, Jammu for subsequent renewal and entry of arms licence in the district of Bhojpur vide Annexure-4, his licence has not been registered in the aforesaid district. Though the licence now stands renewed till 2017 but its entry in the Arms Register of Bhojpur district is necessary for future renewal as every time the petitioner would have to go to Jammu for such purpose.
Having regard to the aforementioned facts and circumstances of the case, this writ application is being disposed of with a direction to the District Magistrate-cum-Licensing Authority, Bhojpur at Ara to take a proper decision in the matter of petitioner within a period of two months from the date of receipt/production of a copy of this order.
