The petitioner seeks bail in Motipur P.S. Case No. 519 of 2019, registered for the offence punishable under Sections 120(B), 121, 121(A), 122 and 123 of the Indian Penal Code, section 25(1-b)a/26 of the Arms Act and sections 16, 18, 20 and 21 of the UAP Act.

As per the prosecution case, on a secret information that one co-accused Vikash Kumar Rajak @ Vikash Kumar Razak who is absconding in Motipur PS Case No. 40 of 2019 is present in his village, a raid was conducted and was apprehended with country made pistol, live cartridge and leaflets of extremists organization and who disclosed the name of this petitioner as one of his associates.

It is submitted on behalf of the petitioner that no arms

Patna High Court CR. MISC. No.46738 of 2021(2) dt.17-11-2021 2/2 and ammunition have been recovered from possession of this petitioner and has got no concern with Naxal organization. Petitioner has been made accused in this case only on the basis of confessional statement of co-accused Vijay Rajak who has been granted bail by this Court vide order dated 07.12.2020 passed in Cr. Misc. No. 25850 of 2020. Petitioner is in custody since 15.12.2020. Chargesheet has already been submitted. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Motipur P.S. Case No. 519 of 2019.
