Learned counsel appearing on behalf of the petitioner submits that he has received instruction from the petitioner that he seeks to file a detailed representation for the relief, as claimed for in the present writ petition, and the admitted facts arising out of the present writ petition as well as the counter affidavit filed on behalf of the respondents and in these backgrounds, he further submits that order contained in Annexure-16 is required to be
Patna High Court CWJC No.8830 of 2020 dt.28-08-2023 2/2 modified by the concerned authority.
3. Considering the specific submission made on behalf of the petitioner, the petitioner, if so advised, may avail appropriate remedy for redressal of his grievance as claimed for in the present writ petition. The deceased employee had died on 16.02.2020 and he was superannuated from the post of Senior Statistical Assistant and the widow of the deceased employee is aggrieved for non-payment of retiral dues.
4. The authority concerned is directed to take a final decision with respect to the entitlement of the petitioner and ensure the payment of dues to the petitioner in accordance with law within a period of six weeks from the date of filing of the representation.
5. With the above observations and directions, the present writ petition stands disposed of.
