JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code. The prosecution case, in short, is that the informant went to his brother's house to enquire about the distribution of money paid by the under raiyats where the petitioner caught hold of the hand of the informant and co-accused Satyendra Chaudhary fired causing injury on the back of the informant.
It is submitted by learned counsel for the petitioner that specific allegation has been levelled against co-accused Satyendra Chaudhary and there is a counter version of the occurrence also. The petitioner happens to be the agnate of the informant and a
Patna High Court Cr.Misc. No.6370 of 2016 (2) dt.10-02-2016 statement has been made that the petitioner has got no criminal antecedent.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sub Judge, Ist-cum-Additional Chief Judicial Magistrate, Bikramganj, District-Rohtas in connection with Sanjhauli P.S. Case No.110 of 2015, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Dinesh Kumar Singh, J) V.P.Sinha/- U
