JUSTICE P. B. BAJANTHRI) 23-07-2025 Appellant has assailed the order of the learned Single Judge dated 11.04.2019 passed in CWJC No. 5644 of 2011. Brief facts of this case is that the appellant was appointed as a Data Assistant in the Health Department on contract basis on 15.06.2006 for a period of eleven months thereafter, it was extended from time to time. The last extension was on 13.01.2009 upto 12.01.2012 whereas, appellant's services have been terminated pre-maturely before expiry of the contract

Patna High Court L.P.A No.591 of 2019(6) dt.23-07-2025 2/2 period on 23.02.2011, on the score that his work was not satisfactory. In this regard, no show cause notice has been issued to the petitioner insofar as unsatisfactory work. Be that as it may, last extension of contract appointment period expires on 12.01.2012.

In the light of these facts and circumstances, at the best, appellant is entitled to arrears of salary or consolidated pay from March 2011 to January 2012, the same shall be calculated and disbursed in favour of the appellant within a period of four months from the date of receipt of this order. To the above extent, order of the learned Single Judge dated 11.04.2019 passed in CWJC No. 5644 of 2011 stands modified, while taking note of the fact that contract appointee has no vested right to continue beyond the time stipulated.

3. With the above observation, the present LPA No. 591 of 2019 stands disposed of. Pending I.A.(s), if any, stands disposed of.
