JUSTICE SATYAVRAT VERMA ORAL ORDER 12-01-2022 Heard the learned counsel for the petitioner and the learned APP for the State through video conferencing. The petitioner seeks bail in connection with Rajauli P. S. Case No.336 of 2019, instituted for the offences under Section 395 of the Indian Penal Code and later on, which was converted under Section 392 of the I.P.C.

The learned counsel for the petitioner submits that the petitioner is in custody since 27.03.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

Allegation is of looting a truck along with mobile of the informant and Khalasi by four unknown criminals, who had intercepted the truck by their Scorpio.

The learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.47008 of 2021(2) dt.12-01-2022 2/2 F.I.R. was against unknown. The name of this petitioner transpired in the confessional statement of co-accused Binay Kumar @ Bigan. It is further submitted that there is no recovery of any incriminating article from the petitioner. He was neither put on T. I. Parade and co-accused Ram Pukar Yadav was granted bail by order dated 08.02.2021 in Cr. Misc. No.3544 of 2021.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 27.03.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case and co-accused has been granted bail, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawada in connection with Rajauli P. S. Case No.336 of 2019. The application stands allowed.
