JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-12-2015 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner is accused in connection with S. Tr. No. 1378 of 2012 arising out of Malsalami P.S. Case No. 104 of 2012 registered under Sections 304(B), 201, 34 of the I.P.C. and later on, section 302 of the I.P.C. was added.

Learned counsel appearing on behalf of the petitioner submits that earlier prayer of the petitioner for bail was rejected vide Cr. Misc. No. 43550 of 2014 by this Court on 28.01.2015 with direction to the trial Court to conclude the trial within six months and if the trial is not concluded within the aforesaid period, the petitioner would be at liberty to renew his prayer for bail, but up-till-now the trial is pending for evidence,

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.D.J., Vth, Patna City in connection with S.T. No. 1378 of 2012 arising out of Malsalami P.S. Case No. 104 of 2012.
