JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-02-2016 Heard learned counsels for the petitioners and the State. The petitioner no. 1 being husband of the victim and petitioner nos. 2 and 3 being parents of petitioner no. 1 are apprehending arrest in a case registered for the offences punishable under Sections 307 and 498A/34 of the Indian Penal Code. Subsequently, section 304B IPC was added. The accusation of causing burn injury to the victim is against the sister in law of the victim namely Rinku Devi. It is alleged against the petitioners that they were present but they failed to rescue the informant. Subsequently, the informant succumbed to the burn injury.
It is submitted by the learned counsel for the petitioners
Patna High Court Cr.Misc. No.5195 of 2016 (2) dt.01-02-2016 2/2 that the accusation of causing burn injury is against co accused Rinku Devi.
Let the learned court below consider the prayer for regular bail of the petitioner no. 1 in case he surrenders within six weeks from today in connection with Ahiyapur P.S. Case No. 981 of 2015 pending in the court of learned C.J.M. Muzaffarpur. So far as petitioner nos. 2 and 3 are concerned, considering the thrust of accusation against petitioner no. 1 and co accused Rinku Devi, let them be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Muzaffarpur in connection with the aforementioned case subject to the conditions as laid down under Section 438(2) Cr.P.C.
