The petitioner has preferred this application for grant of regular bail in connection with Sessions Trial No 217 of 2022 arising out of Udakishunganj PS Case No 112 of 2022 dated 28.04.2022 registered for the offence punishable under Sections 304B/34 of the IPC.

As per the prosecution case, the petitioner and the coaccused persons are alleged to have killed the informant's daughter due to non-fulfillment of demand of Rs 2 lakhs and a motorcycle as dowry.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this

Patna High Court CR. MISC. No.36868 of 2023(2) dt.07-07-2023 2/2 case. The petitioner bears clean antecedent, as stated in paragraph 3 of the bail petition. He is in custody in this case since 03.11.2022.

Learned APP has vehemently opposed the bail petition of the petitioner by submitting that the petitioner is husband of the deceased who was married to the petitioner on 28.04.2022. The post mortem report showed that the cause of death was asphyxia due to hanging.

Considering the aforesaid facts and circumstances of the case as well as the heinous nature of allegation against the petitioner, this Court is not inclined to enlarge the petitioner above named on bail. Prayer for bail is rejected. This application stands rejected.
