A minor child namely, Sunish Kumar was kidnapped for ransom by two persons and for that instant prosecution has been launched by the father of the victim against unknown. From the case diary, it is apparent that the victim, while he was being carried away and taken to Begusarai Station, began to weep attracting presence of the surroundings including GRP personnel who rescued the victim as well as apprehended one person who disclosed his identity as Guddu Rai. Furthermore, Guddu Rai also confessed and named the petitioner including others to be his associates. It is evident that petitioner was apprehended on 01.04.2015 but, the reason best known to the prosecution, had not been put on TIP. Nothing incriminating has

No.31510 of 2015 (3) dt.13-10-2015 been recovered from his possession nor there happens to be any kind of circumstantial evidence save and except inculpatory extra judicial confessional statement of the co-accused. Accordingly, petitioner, Shashi Rai is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Sikrahana, East Champaran at Motihari in connection with Madhuban PS Case No. 04/2015 subject to the condition that till conclusion of the trial, petitioner will not indulge in any kind of coercion, threat, allurement over the victim.
