JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-07-2023 Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners are seeking regular bail in connection with Gopalpur P.S. Case No. 12 of 2023, registered for offence punishable under section 414/34 of the Indian Penal Code. As per allegation, the police searched the pick-up van of the petitioners and recovered aluminum wire, cutter and some other articles from that pick-up van.

The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case.They are under custody since 06.01.2023. Considering the above-mentioned facts and circumstances, let the petitioners above-named be released on

Patna High Court CR. MISC. No.36853 of 2023(2) dt.03-07-2023 2/2 bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Smt. Ranjana Dubey, learned Judicial Magistrate 1st Class, Patna in connection with Gopalpur P.S. Case No. 12 of 2023, subject to the following conditions:- (i) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.

(ii) If the petitioners are found involved in future in the similar type of offence, their bail bonds shall be liable to be cancelled.

(iii) The petitioners shall remain present physically before the court below on each and every date till framing of charge, and their failure in physical appearance on two consecutive dates shall lead to cancellation of their bail bonds.
