JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-04-2021 Heard Mr. Dharmendra Kumar Paswan, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in connection with Goraul P. S. Case No. 05 of 2020, dated 02.01.2020, instituted for offences under Sections 120 (B), 201, 302 and 498 A of the Indian Penal Code.
The petitioner is the husband of the deceased. It has been submitted on behalf of the petitioner that the case was lodged after inordinate delay and there is no specific accusation against the petitioner. However, regard being had to the nature of
Patna High Court CR. MISC. No.35092 of 2020(4) dt.07-04-2021 2/2 accusation against the petitioner, I am not inclined to grant bail to him for the present.
However, looking at the custody of the petitioner which is from 23.06.2020, this Court directs that the trial of the petitioner be expedited and concluded preferably within a period of nine months. If there is no substantial progress in the case within the aforesaid period, it would be open for the petitioner to approach the court below for grant of bail and in that event, the court below shall be under an obligation to record the reasons for the tardy progress of the trial.
