The petitioner is accused in connection with Bhabua P.S. Case No. 73 of 2019 registered under sections 363 and 364(A) of the I.P.C. pending in the Court of C.J.M., Kaimur at Bhabua.

Submission of learned counsel for the petitioner is that petitioner is in custody since 11.04.2019. He is innocent and has falsely been implicated in the present case. Further submission is that petitioner is not named in the first information report.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that

Patna High Court CR. MISC. No.37534 of 2019(3) dt.11-09-2019 2/2 petitioner has criminal antecedent. He is accused in many cases, as detailed in paragraph-3 of the bail petition. The witnesses have also supported the prosecution version. The body of the victim has not been recovered.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
