JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bhagwanpur Hat P.S. Case No. 195 of 2018 instituted for the offences punishable under Sections 272, 273, 308, 420 of the Indian Penal Code and Sections 30(a) & 41(1) of Bihar Prohibition and Excise Act.
Allegation is of recovery of 5 litres of liquor from the house of the petitioner.
Submission of learned counsel for the petitioner is that he has falsely been implicated and he has no criminal antecedent.
Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that there is recovery from the house of the petitioner, as such this application is not

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. If petitioner surrenders and prays for regular bail, the same shall be considered and, if possible, to be disposed of on the same day, without being prejudiced by this order. With the above observation, this application is dismissed.
