2. The petitioner seeks bail in connection with Special Case No. 108 of 2022 arising out of Naubatpur P.S. Case No. 452 of 2022 registered for the offence under Sections 25(1-b)a, 26, 35 of the Arms Act and Sections 8(c), 21(B)© of the N.D.P.S. Act, 1985.

3. Altogether 11 grams of smack which is intermittent quantity has been recovered from the possession of the petitioner who is in custody since 14.07.2022 and he has clean antecedent. Co-accused, Raj Kumar has been granted bail by this Court from whom 7 grams of smack was recovered. There is recovery of 75 grams of smack from the possession of Bharat Bhushan Patel along with one country made loaded

4. Learned A.P.P. has vehemently opposed the prayer for bail.

5. Considering the period of custody and the recovery of smack, this application for regular bail is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge (NDPS Act), Court No.1, Patna in connection with Naubatpur P.S. Case No. 452 of 2022.

7. The petitioner will visit Naubatpur Police Station on the first & third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
